Why do you need a trust? That is an excellent question!

Let's get right down to business. You want to protect your assets. A will is a writing that expresses what the testator (owner) of real or personal property would like done with those pieces of property. It is a sort of guide for the court when your estate goes through probate. Property will still go through probate if a will is in place but the court will know the wishes of the testator. A trust is an instrument that, like a will, carries out the intent or wishes of the testator except it will not go through probate and instead administered by a trustee.
